Welcome to Retireista. Please read these Terms of Service ("Terms") carefully as they contain important information about your legal rights, remedies, and obligations. By accessing or using Retireista's website, mobile applications, or any other services provided by Retireista (collectively, the "Services"), you agree to comply with and be bound by these Terms.

1. Acceptance of Terms

By registering for, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

We may modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after any such changes constitutes your acceptance of the modified Terms.

2. Account Registration

To access certain features of the Services, you must register for an account. When you register, you agree to:

  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account

Retireista provides retirement planning tools, including scenario modeling, Monte Carlo simulations, and related financial planning services. We offer both Free and Premium subscription plans as described on our Pricing page.

The Services are for informational and educational purposes only and do not constitute financial, legal, or tax advice. We are not financial advisors, and our simulations and projections should not be the sole basis for any investment or financial decisions. We encourage you to consult with qualified professionals regarding your specific circumstances.

4. Subscription and Billing

Subscription details, including pricing and features, are available on our Pricing page. By subscribing to our Premium plan, you agree to pay the applicable fees as they become due.

  • Subscriptions automatically renew until cancelled
  • You authorize us to charge your payment method for all fees incurred
  • All fees are exclusive of taxes, which may be added where applicable
  • We may change our fees at any time, but will provide advance notice for existing subscribers
  • Subscription cancellations are subject to our Cancellation Policy
  • Refunds are governed by our Refund Policy

5. User Conduct

You agree not to:

  • Use the Services in any way that violates applicable laws or regulations
  • Infringe upon the rights of others
  • Attempt to gain unauthorized access to the Services or related systems
  • Interfere with or disrupt the Services or servers connected to the Services
  • Engage in any data mining, scraping, or similar data gathering activities

  • Frame or mirror any part of the Services
  • Sublicense, sell, rent, lease, transfer, assign, or distribute the Services
  • Reverse engineer, decompile, or disassemble the Services

7. User Data

You retain all rights to the data you input into the Services. You grant us a non-exclusive, worldwide, royalty-free license to use, copy, transmit, and display your data solely for the purpose of providing and improving the Services.

We will handle your personal information in accordance with our Privacy Policy.

8. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by following the instructions on our website or contacting us. Upon termination, your right to use the Services will immediately cease.

All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We make no warranty that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. The retirement projections and simulations provided are based on assumptions and historical data, and actual results may vary significantly.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER RETIREISTA NOR ITS DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR CONTENT PROVIDERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, OR COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES.

IN NO EVENT WILL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US DURING THE THREE (3) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Retireista and its officers, directors, employees, agents, and affiliates from and against any claims, disputes, demands, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.

13. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Retireista regarding the Services.
  • Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
  • Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
  • Assignment: You may not assign or transfer these Terms without our prior written consent, but we may assign or transfer these Terms without restriction.
  • Force Majeure: We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control.
